Terms of Service

Last updated: September 2026

Welcome to Pooch & Tabby. Throughout this website, “we,” “us,” and “our” refer to Pooch & Tabby. By accessing our website or placing an order, you agree to these Terms of Service, along with any policies specifically referenced in these Terms, including our Privacy Policy, Shipping & Delivery Policy, and Returns & Exchanges Policy.

Please read these Terms and our other policies before placing an order. If you do not agree with them, please do not use our website or place an order.

1. Using Our Website

You agree to use this website for lawful purposes and in a way that does not interfere with the operation, security or availability of the website.

You may not use our website to:

  • violate any applicable law or regulation;

  • infringe or misuse our intellectual property or the intellectual property of others;

  • introduce viruses, malware or other harmful code;

  • attempt to gain unauthorized access to our website, systems or accounts;

  • scrape, copy or reproduce website content or product information for commercial use without our permission; or

  • engage in fraudulent, abusive, threatening or otherwise inappropriate activity.

We may restrict or terminate access to the website where we reasonably believe it is necessary to protect Pooch & Tabby, our customers, our website or our business.

2. Age and Authorization

By placing an order with Pooch & Tabby, you confirm that you are legally able to enter into the purchase agreement in your jurisdiction, or that you are placing the order with the authorization of a parent or legal guardian.

If you are placing an order using another person's account, payment method or device, you confirm that you have permission to do so.

The person who places an order is responsible for ensuring that the order and payment information are authorized.

3. Products and Made-to-Order Items

Pooch & Tabby products are handmade to order from raw materials according to the options selected when an order is placed.

Unless specifically described otherwise, products are not pre-made and held as general inventory for resale.

Because our products are handmade, minor variations in pattern placement, material appearance, texture, colour and other characteristics may occur. Product photographs are intended to represent the products as accurately as reasonably possible, but colours may appear differently depending on your screen, device and display settings.

Product descriptions provide information about materials, sizing, construction and other characteristics where relevant. Please review the product listing and sizing information before placing an order.

If you are unsure about sizing, materials, hardware, product selection or suitability for your pet, please contact us before ordering. We are happy to help.

4. Product Use and Pet Safety

Pooch & Tabby products are intended to be used only for their stated purpose and in accordance with the instructions and limitations provided with the product or in its listing.

Pet accessories are not indestructible. The suitability and condition of a product can vary depending on the individual animal, its behaviour, strength, activity level and environment.

Customers are responsible for selecting an appropriate product and size for their pet and for regularly inspecting the product for signs of damage or excessive wear.

Dog collars are not designed or intended for tie-outs, tethering or unattended restraint. A collar should not be used as a substitute for equipment specifically designed for those purposes.

Do not continue using a product that is damaged, excessively worn or otherwise appears unsafe.

Pooch & Tabby is not responsible for damage, injury or loss resulting from misuse, improper use, unauthorized use, failure to inspect or maintain a product, or use contrary to the product's stated purpose or safety information.

Nothing in these Terms excludes or limits any liability or consumer rights that cannot legally be excluded or limited under applicable law.

5. Orders and Order Acceptance

When you place an order through our website, you are submitting a request to purchase the products shown in your order.

We reserve the right to decline, cancel or limit an order where reasonably necessary, including in circumstances involving:

  • suspected fraud or unauthorized payment;

  • inaccurate or incomplete order information;

  • pricing, product description or listing errors;

  • product or material availability;

  • an inability to fulfill the order as requested;

  • repeated or unreasonable abuse of our policies or customer service;

  • threatening, abusive or harassing behaviour;

  • misuse or attempted misuse of our website or services; or

  • other circumstances in which we determine that we cannot reasonably fulfill the order.

If we cancel an order before it has been fulfilled, any payment received for the cancelled portion of the order will be refunded.

We may also decline future orders or restrict access to our website where we determine that continuing to provide service is not reasonably appropriate.

6. Order Information and Customer Responsibility

You agree to provide accurate and complete information when placing an order, including your name, shipping address, email address and payment information.

You are responsible for reviewing your order before submitting it and for ensuring that the products, sizes, colours, designs, hardware, quantities and shipping information are correct.

If you provide an incorrect or incomplete shipping address, additional costs or delays may result. Our Address and Shipping policies explain how address problems and undeliverable shipments are handled.

7. Prices and Product Information

Prices, product descriptions, availability and other website information may change from time to time.

We make reasonable efforts to keep our website accurate, but errors can occasionally occur. If we discover a significant error affecting an order, we may contact you to correct the error or cancel the affected order and refund any payment received.

Prices are displayed in the currency indicated at checkout. Taxes, shipping charges, duties, tariffs or other applicable charges will be disclosed or handled as described at checkout and in our applicable policies.

8. Shipping, Delivery and International Orders

Shipping and delivery are governed by our Shipping & Delivery Policy.

Delivery dates and transit times provided on our website, at checkout or by a carrier are estimates unless expressly stated otherwise. Delays can occur due to carrier operations, weather, remote or rural delivery conditions, customs processing, transportation disruptions and other circumstances outside our control.

For international orders, customers are responsible for providing accurate delivery information and for complying with the import requirements of their destination country.

Unless Pooch & Tabby specifically states otherwise at checkout, customs duties, import taxes, tariffs, brokerage fees and other charges imposed by the destination country are the responsibility of the customer. Pooch & Tabby does not control these charges and cannot predict whether or how much a destination country may charge.

Customers are responsible for reviewing the Shipping & Delivery Policy and any information provided at checkout before completing an international order.

9. Returns, Exchanges and Replacements

Returns, exchanges and replacements are governed by our Returns & Exchanges Policy.

Unless otherwise required by applicable law, Pooch & Tabby does not offer returns or exchanges for change of mind, incorrect size selection or personal preference.

If we make an error with your order or an item has a defect that occurred during the making of the item, we will work with you to resolve the issue in accordance with our Returns & Exchanges Policy.

Damage resulting from pet behaviour, misuse, normal wear, environmental exposure or other circumstances described in that policy is not considered a defect.

Nothing in these Terms limits any rights or remedies that apply under applicable consumer-protection law.

10. Cancellations and Changes to Orders

Because our products are handmade to order, orders may enter production shortly after they are received.

Cancellation requests must be submitted within 2 business days of placing an order and before production has begun. To request a cancellation, please contact us as soon as possible at support@poochandtabby.com.

After the 2-business-day cancellation window, cancellations are not guaranteed. However, if production has not yet begun, Pooch & Tabby may, at our discretion, accommodate a cancellation request.

Once production has begun, we generally cannot cancel or modify the order.

Orders that have already been completed or shipped cannot be cancelled through the normal order-change process.

Any cancellation rights provided by applicable consumer-protection law remain unaffected.

11. Website Content and Intellectual Property

All content on this website, including photographs, product descriptions, graphics, logos, designs, written content and other original material, belongs to Pooch & Tabby or is used with permission.

You may view and use the website for your personal, non-commercial purposes.

You may not reproduce, modify, distribute, sell, publish or commercially use our website content without our written permission.

12. Customer Reviews, Photos and Feedback

If you voluntarily provide a review, photograph, testimonial or other feedback to Pooch & Tabby, you give us permission to use that material for reasonable business purposes, including displaying it on our website, social media or other Pooch & Tabby marketing channels.

You remain responsible for ensuring that any material you provide does not violate another person's rights or contain unlawful or misleading content.

We may remove or decline to publish submitted content where we consider it inappropriate, misleading, unlawful or unrelated to our business.

We will not treat private customer communications as public submissions simply because they are sent to us.

13. Third-Party Services and Links

Our website may use third-party services to provide functions such as payment processing, website hosting, shipping, analytics or other services.

Those services may have their own terms and privacy policies. Your use of third-party services may therefore be subject to those providers' terms in addition to these Terms.

Our website may also contain links to third-party websites. We are not responsible for the content, availability, security or practices of websites that we do not operate.

14. Privacy

Your use of our website and the information you provide to us are governed by our Privacy Policy.

Our Privacy Policy explains what personal information we collect, why we collect it, how it is used and disclosed, and how it is protected.

15. Fraud, Abuse and Misuse

We take fraudulent activity and deliberate misuse of our policies seriously.

This includes, without limitation, knowingly providing false information about an order, falsely claiming that an order was not received, attempting to obtain a refund or replacement through false or misleading information, unauthorized payment activity, or repeatedly abusing our customer-service or replacement policies.

Where appropriate, we may refuse or cancel orders, restrict future purchases, retain relevant records, dispute fraudulent claims and take other reasonable steps available to us.

Nothing in this section prevents a customer from making a legitimate complaint or reporting a genuine problem with an order.

16. Disclaimer and Limitation of Liability

We make reasonable efforts to ensure that the information on our website is accurate and that products are made with care and according to their stated specifications.

However, our website and its content are provided on an “as available” basis, and we do not guarantee that the website will always be uninterrupted, error-free or available.

Pooch & Tabby is not responsible for loss, damage, delay or other consequences arising from circumstances outside our reasonable control, including carrier delays, customs delays, weather, transportation disruptions, incorrect customer-provided information, misuse of a product, unauthorized use, or failure to follow product instructions or safety information.

To the maximum extent permitted by applicable law, Pooch & Tabby will not be liable for indirect, incidental or consequential losses arising from the use of our website or products.

Nothing in these Terms excludes, restricts or limits any warranty, condition, liability, consumer right or remedy that cannot legally be excluded, restricted or limited under applicable law.

17. Indemnification

To the extent permitted by applicable law, you agree to be responsible for losses, claims or expenses arising from your unlawful use of our website, your violation of these Terms, or your misuse of our products.

This section does not apply to the extent that a claim results from our own negligence, unlawful conduct or any other

circumstance for which liability cannot legally be excluded.

18. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, or removed to the extent necessary, without affecting the validity of the remaining provisions.

19. Entire Agreement

These Terms, together with the policies expressly referenced in them, form the agreement between you and Pooch & Tabby regarding your use of our website and your purchases from us.

If there is a conflict between these Terms and a specific policy that applies to a particular issue, the more specific policy will govern that issue.

Nothing in these Terms limits rights or obligations that cannot legally be excluded or modified.

20. Governing Law

These Terms are governed by the laws of Ontario and the applicable laws of Canada.

If you are located outside Ontario, mandatory consumer-protection laws that apply to your purchase may provide additional rights that cannot be excluded by these Terms.

21. Changes to These Terms

We may update these Terms from time to time to reflect changes to our business, website, products, policies or legal requirements.

The current version will be posted on this website with its effective date. Your continued use of the website after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by law.

Changes will not retroactively alter the terms applicable to an order that has already been placed, except where required by law.
